Utilities Code § 53.306","heading":"COMMISSION REVIEW OF PROPOSED CHANGE.","body":"(a) The commission shall review a proposed change filed under this subchapter if:\n(1) the commission receives complaints relating to the proposed change signed by a number of affected local service customers equal at least to the lesser of 1,500 or five percent of those customers;\n(2) the commission receives a complaint relating to the proposed change from an affected intrastate access customer, or a group of affected intrastate access customers, that in the preceding 12 months accounted for more than 10 percent of the company's total intrastate gross access revenues;\n(3) the proposed change is not a minor change;\n(4) the company does not comply with the procedural requirements of this subchapter; or\n(5) the proposed change is inconsistent with the commission's substantive policies as expressed in its rules.\n(b) The commission may suspend a tariff proposed under this subchapter during the review.\nActs 1997, 75th Leg., ch. 166, Sec. 1, eff.
