Utilities Code § 59.053","heading":"WAIVER OF INFRASTRUCTURE REQUIREMENTS.","body":"(a) For an electing company that serves fewer than one million lines, the commission may waive a requirement prescribed by Section 59.052 if the company demonstrates that the investment is not viable economically.\n(b) Before granting a waiver under Subsection (a), the commission must consider the public benefits that would result from compliance with the requirement.\nActs 1997, 75th Leg., ch. 166, Sec. 1, eff.
