Water Code § 11.401","heading":"SCOPE OF SUBCHAPTER.","body":"The provisions of this subchapter apply to a suit if:\n(1) the state is a party;\n(2) the purpose of the suit is to determine the right of the parties to divert or use water of a surface stream; and\n(3) rights are asserted to use water in, or divert water to, not more than four counties.\nAmended by Acts 1977, 65th Leg., p. 2207, ch. 870, Sec. 1, eff.
