Water Code § 53.122","heading":"REGULATING SANITARY CONDITIONS INSIDE THE DISTRICT.","body":"(a) A district may regulate the installation, maintenance, and operation of plumbing fixtures and facilities inside the district for the purpose of:\n(1) maintaining safe and sanitary conditions; and\n(2) protecting the lives, health, and welfare of the people in the district.\n(b) The board may set a reasonable penalty for violating any rule authorized by Subsection (a) of this section, within these limits:\n(1) a fine of not more than $200;\n(2) confinement in the county jail for not more than 30 days; or\n(3) both the fine and the jail sentence.\n(c) The penalty set by the supervisors is in addition to other penalties provided by law. A court of proper jurisdiction in the county where the district's principal office is located may enforce the penalties.\n(d) A penalty for the violation of a rule is not valid unless a brief, substantial statement of the rule and the penalty is published once a week for two consecutive weeks in a newspaper of general circulation in the area in which the district is located. A penalty takes effect seven days after the second publication.\n(e) The courts shall take judicial notice of the rules made by a district under this section.\nActs 1971, 62nd Leg., p. 411, ch. 58, Sec. 1, eff.
