{"data":{"id":"us-ut/utah-code-10-2-501","jurisdiction":"us-ut","citation":"Utah Code § 10-2-501","heading":"Municipal disconnection -- Definitions -- Request for disconnection -- Requirements upon filing request -- Notice.","body":"(1) As used in this part \"petitioner\" means:\n(a) one or more persons who:\n(i) own title to real property within the area proposed for disconnection; and\n(ii) sign a request for disconnection proposing to disconnect the area proposed for disconnection from the municipality; or\n(b) the mayor of the municipality within which the area proposed for disconnection is located who signs a request for disconnection proposing to disconnect the area proposed for disconnection from the municipality.\n(2)\n(a) A petitioner proposing to disconnect an area within and lying on the borders of a municipality shall file with that municipality's legislative body a request for disconnection.\n(b) Each request for disconnection shall:\n(i) contain the names, addresses, and signatures of the owners of more than 50% of any private real property in the area proposed for disconnection;\n(ii) give the reasons for the proposed disconnection;\n(iii) include a map or plat of the territory proposed for disconnection; and\n(iv) designate between one and five persons with authority to act on the petitioner's behalf in the proceedings.\n(3) Upon receiving a request for disconnection, a municipal legislative body shall publish notice of the request:\n(a) in accordance with the legal notice requirements described in Section 45-1-101, for three weeks before the day of the public hearing described in Section 10-2-502.5; and\n(b) for the area proposed to be disconnected, as a class B notice under Section 63G-30-102, for at least three weeks before the day of the public hearing described in Section 10-2-502.5.\n(4) A municipal legislative body may bill the petitioner for the cost of preparing, printing, and publishing the notice required under Subsection (3).","path":["Title 10 Utah Municipal Code","Chapter 10-2 Classification, Boundaries, Consolidation, and Dissolution of Municipalities","Part 10-2-5 Restriction of Municipal Limits"],"source_url":"https://le.utah.gov/xcode/Title10/Chapter2/10-2-S501.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"26319722b5c87c3ce1c762e4e40e324e9659cc6878c1bad3884d79282eb5d60f","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-10-2-306","next":"us-ut/utah-code-10-2-502.5"},"notice":"GroundRules: Original legal text.
