{"data":{"id":"us-ut/utah-code-10-20-614","jurisdiction":"us-ut","citation":"Utah Code § 10-20-614","heading":"Cannabis production establishments, medical cannabis pharmacies, and industrial hemp producer licensee.","body":"(1) As used in this section:\n(a) \"Cannabis production establishment\" means the same as that term is defined in Section 4-41a-102 and includes a closed-door medical cannabis pharmacy.\n(b) \"Closed-door medical cannabis pharmacy\" means the same as that term is defined in Section 4-41a-102.\n(c) \"Industrial hemp producer licensee\" means the same as the term \"medical cannabis research licensee\" is defined in Section 4-41-102.\n(d) \"Medical cannabis pharmacy\" means the same as that term is defined in Section 26B-4-201.\n(2)\n(a)\n(i) A municipality may not regulate a cannabis production establishment or a medical cannabis pharmacy in conflict with:\n(A) Title 4, Chapter 41a, Cannabis Production Establishments and Pharmacies, and applicable jurisprudence; and\n(B) this chapter.\n(ii) A municipality may not regulate an industrial hemp producer licensee in conflict with:\n(A) Title 4, Chapter 41, Hemp and Cannabinoid Act, and applicable jurisprudence; and\n(B) this chapter.\n(b) The Department of Agriculture and Food has plenary authority to license programs or entities that operate a cannabis production establishment or a medical cannabis pharmacy.\n(3)\n(a) Within the time period described in Subsection (3)(b), a municipality shall prepare and adopt a land use regulation, development agreement, or land use decision in accordance with this title and:\n(i) regarding a cannabis production establishment, Section 4-41a-406; or\n(ii) regarding a medical cannabis pharmacy, Section 4-41a-1105.\n(b) A municipality shall take the action described in Subsection (3)(a):\n(i) before January 1, 2021, within 45 days after the day on which the municipality receives a petition for the action; and\n(ii) after January 1, 2021, in accordance with Section 10-20-905.","path":["Title 10 Utah Municipal Code","Chapter 10-20 Municipal Land Use, Development, and Management Act","Part 10-20-6 Land Use Regulations - Particular Situations"],"source_url":"https://le.utah.gov/xcode/Title10/Chapter20/10-20-S614.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"9c34e95c592fb49c0efe2b8063b360b17fd619f59c2a24ab8530fc45839b7dfc","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-10-20-613","next":"us-ut/utah-code-10-20-615"},"notice":"GroundRules: Original legal text.
