{"data":{"id":"us-ut/utah-code-10-3-1109.5","jurisdiction":"us-ut","citation":"Utah Code § 10-3-1109.5","heading":"Overtime for law enforcement personnel.","body":"(1) As used in this section:\n(a) \"Nonexempt employee\" means a municipal employee who is nonexempt under the requirements of the Fair Labor Standards Act of 1978, 29 U.S.C. Sec. 201 et seq.\n(b) \"Overtime\" means hours worked in excess of a nonexempt employee's work period.\n(c) \"Regular hourly rate\" means the hourly rate of pay a nonexempt employee receives for hours worked during a work period.\n(d) \"Work period\" means the maximum number of hours, within a specified number of consecutive days, that a nonexempt employee may work before the nonexempt employee is compensated for overtime.\n(2) The governing body of a municipality that employs a nonexempt employee engaged in law enforcement activities may, except as otherwise required by a contract or a collective bargaining agreement, enact an ordinance or pass a resolution that:\n(a) designates a work period for the nonexempt employee that is the same as, or equivalent to, a work period described in Subsection 63A-17-502(2); and\n(b) compensates the nonexempt employee for overtime at a rate of one and one-half times the nonexempt employee's regular hourly rate.","path":["Title 10 Utah Municipal Code","Chapter 10-3 Municipal Government","Part 10-3-11 Personnel Rules and Benefits"],"source_url":"https://le.utah.gov/xcode/Title10/Chapter3/10-3-S1109.5.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"ba1c746f21605de3d91da086587173af608cc597e2cc241c4ccee8055b8c3491","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-10-3-1109","next":"us-ut/utah-code-10-3-1110"},"notice":"GroundRules: Original legal text.
