{"data":{"id":"us-ut/utah-code-10-3-703.7","jurisdiction":"us-ut","citation":"Utah Code § 10-3-703.7","heading":"Administrative proceedings -- Penalty for code violation.","body":"(1) A municipality may adopt an ordinance establishing an administrative proceeding to review and decide a violation of a civil municipal ordinance.\n(2) An ordinance adopted in accordance with Subsection (1) shall provide due process for parties participating in the administrative proceeding.\n(3)\n(a) A municipality may not impose a nonjudicial penalty for a violation of a land use regulation or a nuisance ordinance unless the municipality provides to the individual who is subject to the penalty written notice that:\n(i) identifies the relevant regulation or ordinance at issue;\n(ii) specifies the violation of the relevant regulation or ordinance; and\n(iii) provides for a reasonable time to cure the violation, taking into account the cost of curing the violation.\n(b) A municipality may not collect on a nonjudicial penalty for a violation of a land use regulation or a nuisance ordinance that is outstanding or pending on or after May 14, 2019, unless the municipality imposed the outstanding or pending penalty in relation to a written notice that:\n(i) identified the relevant regulation or ordinance at issue;\n(ii) specified the violation of the relevant regulation or ordinance; and\n(iii) provided for a reasonable time to cure the violation, taking into account the cost of curing the violation.","path":["Title 10 Utah Municipal Code","Chapter 10-3 Municipal Government","Part 10-3-7 Municipal Ordinances, Resolutions, and Procedure"],"source_url":"https://le.utah.gov/xcode/Title10/Chapter3/10-3-S703.7.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"87199513ee328dba8f854c0c75fea7cddac48a87f845b8ded437c7c02b8d31c1","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-10-3-703","next":"us-ut/utah-code-10-3-704"},"notice":"GroundRules: Original legal text.
