{"data":{"id":"us-ut/utah-code-10-5-113","jurisdiction":"us-ut","citation":"Utah Code § 10-5-113","heading":"Accumulation of retained earnings or fund balance -- Limit as to general fund -- Reserve for capital improvements.","body":"(1) A town may accumulate retained earnings or fund balances, as appropriate, in any fund.\n(2) The accumulation of a fund balance in the town general fund may not exceed 100% of the total revenue of the town general fund for the current fiscal period.\n(3)\n(a) The town council may, in a budget year, appropriate from estimated revenue or excess fund balance in the town general fund to a reserve for capital improvements:\n(i) for the purpose of financing future specified capital improvements; and\n(ii) in accordance with a formal long-range capital plan adopted by the governing body.\n(b) The reserves described in Subsection (3)(a) may accumulate from year to year in a capital improvements fund until the accumulated total is sufficient to permit economical expenditure for the specified purposes.","path":["Title 10 Utah Municipal Code","Chapter 10-5 Uniform Fiscal Procedures Act for Utah Towns"],"source_url":"https://le.utah.gov/xcode/Title10/Chapter5/10-5-S113.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"05fd217d685478a7bc196e6013e4a8c3d67355b4b587889b7d1d147f7dc5b45b","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-10-5-112.5","next":"us-ut/utah-code-10-5-114"},"notice":"GroundRules: Original legal text.
