{"data":{"id":"us-ut/utah-code-10-7-16","jurisdiction":"us-ut","citation":"Utah Code § 10-7-16","heading":"Call for bids -- Notice -- Contents.","body":"(1)\n(a) Before holding an election under Subsection 10-7-15(1)(a)(ii), the municipal legislative body shall open to bid the sale or lease of the property mentioned in Section 10-7-15.\n(b) The municipal legislative body shall publish notice of the bid process for the municipality, as a class A notice under Section 63G-30-102, for at least three consecutive weeks.\n(c) The notice described in Subsection (1) shall:\n(i) give a general description of the property to be sold or leased;\n(ii) specify the time when sealed bids for the property, or for a lease on the property, will be received; and\n(iii) specify the time when and the place where the bids will be opened.\n(2)\n(a) As used in this section and in Section 10-7-17, \"responsible bidder\" means an entity with a proven history of successful operation of an electrical generation and distribution system, or an equivalent proven history.\n(b) Subject to Subsection (2)(c), a municipal legislative body may receive or refuse to receive any bid submitted for the sale or lease of the electrical works and plant.\n(c) A municipal legislative body may not receive a bid unless the municipal legislative body determines that the bid is submitted by a responsible bidder.","path":["Title 10 Utah Municipal Code","Chapter 10-7 Miscellaneous Powers of Cities and Towns","Part 10-7-4 Sale or Lease of Power Plants"],"source_url":"https://le.utah.gov/xcode/Title10/Chapter7/10-7-S16.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"f3dfa0a2979b07ea152b40f33ff44fa52d7378530bd7be698b097cb785a44062","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-10-7-15","next":"us-ut/utah-code-10-7-17"},"notice":"GroundRules: Original legal text.
