{"data":{"id":"us-ut/utah-code-10-8-84.6","jurisdiction":"us-ut","citation":"Utah Code § 10-8-84.6","heading":"Prohibition on licensing or certification of child care programs.","body":"(1)\n(a) As used in this section, \"child care program\" means a child care facility or program operated by a person who holds a license or certificate from the Department of Health and Human Services under Title 26B, Chapter 2, Part 4, Child Care Licensing.\n(b) \"Child care program\" does not include a child care program for which a municipality provides oversight, as described in Subsection 26B-2-405(2)(e).\n(2) A municipality may not enact or enforce an ordinance that:\n(a) imposes licensing or certification requirements for a child care program; or\n(b) governs the manner in which child care is provided in a child care program.\n(3) This section does not prohibit a municipality from:\n(a) requiring a business license to operate a business within the municipality; or\n(b) imposing requirements related to building, health, and fire codes.","path":["Title 10 Utah Municipal Code","Chapter 10-8 Powers and Duties of Municipalities"],"source_url":"https://le.utah.gov/xcode/Title10/Chapter8/10-8-S84.6.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"0d5187996ed7720879086f9c227db7e3adef8201764cf2dae71ac8b630d72cb8","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-10-8-84.5","next":"us-ut/utah-code-10-8-85"},"notice":"GroundRules: Original legal text.
