{"data":{"id":"us-ut/utah-code-11-26-301","jurisdiction":"us-ut","citation":"Utah Code § 11-26-301","heading":"Definitions -- Prohibition on imposition of transportation utility fee.","body":"(1) As used in this section:\n(a)\n(i) \"Legal subdivision\" means a local government that is recognized by Utah Constitution, Article XI.\n(ii) \"Legal subdivision\" does not include a local government that Utah Constitution, Article XI, only authorizes the Legislature to create.\n(b) \"Municipality\" means the same as that term is defined in Section 10-1-104.\n(c) \"Transportation utility fee\" means an ongoing, regular fee imposed:\n(i) by a municipality for the purpose of maintaining public roads; and\n(ii) on utility customers within the municipality.\n(2) A municipality may not impose a transportation utility fee on a legal subdivision.\n(3) This section does not grant to a municipality any authority not otherwise provided for by law to impose a transportation utility fee.","path":["Title 11 Cities, Counties, and Local Taxing Units","Chapter 11-26 Limitations on Local Taxes and Fees","Part 11-26-3 Transportation Utility Fee"],"source_url":"https://le.utah.gov/xcode/Title11/Chapter26/11-26-S301.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"b199a19ec657412981003a41ae1becc76f4e44d3bc7a3ef64f947350c1299cd7","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-11-26-202","next":"us-ut/utah-code-11-26-401"},"notice":"GroundRules: Original legal text.
