{"data":{"id":"us-ut/utah-code-11-36a-205","jurisdiction":"us-ut","citation":"Utah Code § 11-36a-205","heading":"Environmental mitigation impact fees.","body":"Notwithstanding the requirements and prohibitions of this chapter, a local political subdivision may impose and assess an impact fee for environmental mitigation when:\n(1) the local political subdivision has formally agreed to fund a Habitat Conservation Plan to resolve conflicts with the Endangered Species Act of 1973, 16 U.S.C. Sec. 1531, et seq. or other state or federal environmental law or regulation;\n(2) the impact fee bears a reasonable relationship to the environmental mitigation required by the Habitat Conservation Plan; and\n(3) the legislative body of the local political subdivision adopts an ordinance or resolution:\n(a) declaring that an impact fee is required to finance the Habitat Conservation Plan;\n(b) establishing periodic sunset dates for the impact fee; and\n(c) requiring the legislative body to:\n(i) review the impact fee on those sunset dates;\n(ii) determine whether or not the impact fee is still required to finance the Habitat Conservation Plan; and\n(iii) affirmatively reauthorize the impact fee if the legislative body finds that the impact fee must remain in effect.","path":["Title 11 Cities, Counties, and Local Taxing Units","Chapter 11-36a Impact Fees Act","Part 11-36a-2 Impact Fees"],"source_url":"https://le.utah.gov/xcode/Title11/Chapter36a/11-36a-S205.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"4020e4a6ab372882c4801c865f3a743a57086cdea7e9973bc915d99b98ce25e7","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-11-36a-204","next":"us-ut/utah-code-11-36a-206"},"notice":"GroundRules: Original legal text.
