{"data":{"id":"us-ut/utah-code-11-36a-306","jurisdiction":"us-ut","citation":"Utah Code § 11-36a-306","heading":"Certification of impact fee analysis.","body":"(1) An impact fee facilities plan shall include a written certification from the person or entity that prepares the impact fee facilities plan that states the following:\n\"I certify that the attached impact fee facilities plan:\n1. includes only the costs of public facilities that are:\na. allowed under the Impact Fees Act; and\nb. actually incurred; or\nc. projected to be incurred or encumbered within six years after the day on which each impact fee is paid;\n2. does not include:\na. costs of operation and maintenance of public facilities; or\nb. costs for qualifying public facilities that will raise the level of service for the facilities, through impact fees, above the level of service that is supported by existing residents; and\n3. complies in each and every relevant respect with the Impact Fees Act.\"\n(2) An impact fee analysis shall include a written certification from the person or entity that prepares the impact fee analysis which states as follows:\n\"I certify that the attached impact fee analysis:\n1. includes only the costs of public facilities that are:\na. allowed under the Impact Fees Act; and\nb. actually incurred; or\nc. projected to be incurred or encumbered within six years after the day on which each impact fee is paid;\n2. does not include:\na. costs of operation and maintenance of public facilities; or\nb. costs for qualifying public facilities that will raise the level of service for the facilities, through impact fees, above the level of service that is supported by existing residents;\n3. offsets costs with grants or other alternate sources of payment; and\n4. complies in each and every relevant respect with the Impact Fees Act.\"","path":["Title 11 Cities, Counties, and Local Taxing Units","Chapter 11-36a Impact Fees Act","Part 11-36a-3 Establishing an Impact Fee"],"source_url":"https://le.utah.gov/xcode/Title11/Chapter36a/11-36a-S306.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"7c3bd1f9f844033acd3985a8ae532067dc50648284fe1f9410b31322b6f2da1c","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-11-36a-305","next":"us-ut/utah-code-11-36a-401"},"notice":"GroundRules: Original legal text.
