{"data":{"id":"us-ut/utah-code-11-42-104","jurisdiction":"us-ut","citation":"Utah Code § 11-42-104","heading":"Waiver by property owners -- Requirements.","body":"(1) The owners of property to be assessed within an assessment area may waive:\n(a) the prepayment period under Subsection 11-42-411(6);\n(b) a procedure that a local entity is required to follow to:\n(i) designate an assessment area; or\n(ii) levy an assessment; or\n(c) a period to contest a local entity action.\n(2) Each waiver under this section shall:\n(a) be in writing;\n(b) be signed by all the owners of property to be assessed within the assessment area;\n(c) describe the prepayment period, procedure, or contest period being waived;\n(d) state that the owners waive the prepayment period, procedure, or contest period; and\n(e) state that the owners consent to the local entity taking the required action to waive the prepayment period, procedure, or contest period.","path":["Title 11 Cities, Counties, and Local Taxing Units","Chapter 11-42 Assessment Area Act","Part 11-42-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title11/Chapter42/11-42-S104.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"301be02fa6f0e083acf60ba4dfadc558c4d47c597709126ba08f6fa3bb64c57e","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-11-42-103","next":"us-ut/utah-code-11-42-105"},"notice":"GroundRules: Original legal text.
