{"data":{"id":"us-ut/utah-code-11-42a-103","jurisdiction":"us-ut","citation":"Utah Code § 11-42a-103","heading":"No limitation on other local entity powers -- Conflict with other statutory provisions.","body":"(1) This chapter does not limit a power that a local entity has under other applicable law to:\n(a) make an improvement or provide a service;\n(b) create a district;\n(c) levy an assessment or tax; or\n(d) issue a bond or a refunding bond.\n(2) If there is a conflict between a provision of this chapter and any other statutory provision, the provision of this chapter governs.\n(3) After January 1, 2017, a local entity or the C-PACE district may create an energy assessment area within the certificated service territory of a public electrical utility for the installation of a clean energy system with a nameplate rating of:\n(a) no more than 2.0 megawatts; or\n(b) more than 2.0 megawatts to serve load that the public electrical utility does not already serve.","path":["Title 11 Cities, Counties, and Local Taxing Units","Chapter 11-42a Commercial Property Assessed Clean Energy Act","Part 11-42a-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title11/Chapter42a/11-42a-S103.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"381e432b0c9e2533a8ca73ea95fa68fc01147faf20464b5e7ff80017b78515bd","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-11-42a-102","next":"us-ut/utah-code-11-42a-104"},"notice":"GroundRules: Original legal text.
