{"data":{"id":"us-ut/utah-code-11-51a-102","jurisdiction":"us-ut","citation":"Utah Code § 11-51a-102","heading":"Definitions.","body":"As used in this chapter:\n(1) \"Catastrophic public nuisance\" means a condition on state or federal land where natural resources and biota have been managed or neglected to such an extent as to cause:\n(a) the threat of a catastrophic wildfire demonstrated by:\n(i) stand density, basal area, or ground fuel load greater than 150% of land health standards; or\n(ii) an insect or disease infestation severe enough to threaten the mortality of at least 20% of the trees in the area; or\n(b) a condition in the area that threatens the:\n(i) quantity or quality of the public water supply of a political subdivision;\n(ii) health, safety, or welfare of the citizens of a political subdivision;\n(iii) air quality of a nonattainment area; or\n(iv) vegetative resources required to support land health and authorized livestock grazing.\n(2) \"Chief executive officer\" means:\n(a) for a municipality:\n(i) the mayor, if the municipality is operating under a form of municipal government other than the council-manager form of government; or\n(ii) the city manager, if the municipality is operating under the council-manager form of government; and\n(b) for a county:\n(i) the chair of the county commission, if the county is operating under the county commission or expanded county commission form of government;\n(ii) the county executive officer, if the county is operating under the county-executive form of government; or\n(iii) the county manager, if the county is operating under the council-manager form of government.\n(3) \"County sheriff\" means an individual:\n(a) elected to the office of county sheriff; and\n(b) who fulfills the duties described in Section 17-72-201.\n(4) \"Federal agency\" means the:\n(a) United States Bureau of Land Management;\n(b) United States Forest Service;\n(c) United States Fish and Wildlife Service; or\n(d) National Park Service.\n(5) \"Federally managed land\" means land that is managed by a federal agency.\n(6) \"Political subdivision\" means a municipality or county.","path":["Title 11 Cities, Counties, and Local Taxing Units","Chapter 11-51a Catastrophic Public Nuisance Act","Part 11-51a-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title11/Chapter51a/11-51a-S102.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"1ac5244acc863337c37fe60a9ba08d6a0d1087a4f8e1ee557157c4662dd17533","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-11-51a-101","next":"us-ut/utah-code-11-51a-103"},"notice":"GroundRules: Original legal text.
