{"data":{"id":"us-ut/utah-code-11-58-603","jurisdiction":"us-ut","citation":"Utah Code § 11-58-603","heading":"Use of authority money for business recruitment incentive.","body":"(1) As used in this section:\n(a) \"Business recruitment incentive\" means the post-performance payment of property tax differential as an incentive for development within a project area, as provided in this section.\n(b) \"Incentive application\" means an application for a business recruitment incentive.\n(c) \"Tax differential parcel\" means a parcel of land where development activity occurs.\n(2) The authority may use property tax differential as a business recruitment incentive as provided in this section.\n(3) The board shall establish:\n(a) the requirements for a person to qualify for a business recruitment incentive;\n(b) the application timeline, documentation requirements, and approval criteria applicable to an incentive application; and\n(c) the standards and criteria for approval of an incentive application.\n(4)\n(a) Subject to Subsection (4)(b), a person may qualify for a business recruitment incentive if:\n(i) the person submits an incentive application according to requirements established by the board;\n(ii) the person meets the requirements established by the board for a business recruitment incentive; and\n(iii) the board approves the incentive application.\n(b) A person may not qualify for a business recruitment incentive if the person's development project :\n(i) is on authority jurisdictional land; and\n(ii) relates primarily to retail operations or the distribution of goods.\n(5) The authority may pay a person, on a post-performance basis and as determined by the board, a percentage of property tax differential:\n(a) generated from a tax differential parcel and paid to the authority; and\n(b) for a specified period of time.","path":["Title 11 Cities, Counties, and Local Taxing Units","Chapter 11-58 Utah Inland Port Authority Act","Part 11-58-6 Property Tax Differential"],"source_url":"https://le.utah.gov/xcode/Title11/Chapter58/11-58-S603.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"795f4c6dec3ff468a46a0a2424d01cc5be9413980db25e5878a33c8d71b2c82d","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-11-58-602","next":"us-ut/utah-code-11-58-604"},"notice":"GroundRules: Original legal text.
