{"data":{"id":"us-ut/utah-code-13-14-308","jurisdiction":"us-ut","citation":"Utah Code § 13-14-308","heading":"Private right of action.","body":"(1) A franchisee has a private right of action for actual damages and reasonable attorney fees against a franchisor for a violation of this chapter that results in damage to the franchisee.\n(2)\n(a) As used in this Subsection (2):\n(i) \"New franchisor\" has the same meaning as defined in Section 13-14-302.5.\n(ii) \"Reinstated franchise\" has the same meaning as defined in Section 13-14-302.5.\n(iii) \"Reinstated franchisee\" has the same meaning as defined in Section 13-14-302.5.\n(b) A reinstated franchisee has a private right of action for actual damages and reasonable attorney fees against a new franchisor if:\n(i) the new franchisor:\n(A) establishes a new franchisee of the same line-make as a line-make of the reinstated franchisee within the relevant market area of the reinstated franchisee; or\n(B) adds a line-make to another franchisor's existing franchisee within the relevant market area of the reinstated franchisee that is the same line-make as a line-make of the reinstated franchisee; and\n(ii) the franchisor's action under Subsection (2)(b)(i) causes a substantial diminution in value of the reinstated franchisee's reinstated franchise.\n(c) A new franchisor may not be held liable under Subsection (2)(b) based on a franchisee's purchase of another existing franchise, both of which are within the relevant market area of a reinstated franchisee, for the purpose of combining the purchased franchise with the franchise of the purchasing franchisee.","path":["Title 13 Commerce and Trade","Chapter 13-14 New Automobile Franchise Act","Part 13-14-3 Restrictions on Termination, Relocation, and Establishment of Franchises"],"source_url":"https://le.utah.gov/xcode/Title13/Chapter14/13-14-S308.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"5ccbcb4116115b10cf83debcd7b8a62c6a06ce6ce13429a14fc106a036e73af1","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-13-14-307.5","next":"us-ut/utah-code-13-14-309"},"notice":"GroundRules: Original legal text.
