{"data":{"id":"us-ut/utah-code-13-2-102","jurisdiction":"us-ut","citation":"Utah Code § 13-2-102","heading":"Consumer protection division established -- Functions.","body":"(1) There is established within the Department of Commerce the Division of Consumer Protection.\n(2) The division shall administer and enforce the following:\n(a) Chapter 10a, Music Licensing Practices Act;\n(b) Chapter 11, Utah Consumer Sales Practices Act;\n(c) Chapter 15, Business Opportunity Disclosure Act;\n(d) Chapter 20, New Motor Vehicle Warranties Act;\n(e) Chapter 21, Credit Services Organizations Act;\n(f) Chapter 22, Charitable Solicitations Act;\n(g) Chapter 23, Fitness Center Services Protection Act;\n(h) Chapter 25a, Telephone and Facsimile Solicitation Act;\n(i) Chapter 26, Telephone Fraud Prevention Act;\n(j) Chapter 28, Prize Notices Regulation Act;\n(k) Chapter 32a, Pawnshop, Secondhand Merchandise, and Catalytic Converter Transaction Information Act;\n(l) Chapter 34, Utah Postsecondary School and State Authorization Act;\n(m) Chapter 41, Price Controls During Emergencies Act;\n(n) Chapter 42, Uniform Debt-Management Services Act;\n(o) Chapter 49, Immigration Consultants Registration Act;\n(p) Chapter 51, Transportation Network Company Registration Act;\n(q) Chapter 52, Residential Solar Energy Consumer Protection Act;\n(r) Chapter 53, Residential, Vocational and Life Skills Program Act;\n(s) Chapter 54, Ticket Website Sales Act;\n(t) Chapter 56, Ticket Transferability Act;\n(u) Chapter 57, Maintenance Funding Practices Act;\n(v) Chapter 61, Utah Consumer Privacy Act;\n(w) Chapter 64, Vehicle Value Protection Agreement Act;\n(x) Chapter 65, Utah Commercial Email Act;\n(y) Chapter 67, Online Dating Safety Act;\n(z) Chapter 68, Lawyer Referral Consultants Registration Act;\n(aa) Chapter 70, Automatic Renewal Contracts Act;\n(bb) Chapter 71, Utah Minor Protection in Social Media Act;\n(cc) Chapter 72a, Artificial Intelligence Applications Relating to Mental Health;\n(dd) Chapter 77, Generative Artificial Intelligence - Consumer Disclosures and Enforcement;\n(ee) Chapter 78, Earned Wage Access Services Act;\n(ff) Title 78B, Chapter 3, Part 10, Liability for Publishers and Distributors of Material Harmful to Minors;\n(gg) Chapter 81, Utah Digital Choice Act;\n(hh) Chapter 82, Feminine Hygiene Products; and\n(ii) Chapter 83, Virtual Currency Kiosk Regulation.\n(3) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the division may make rules to establish:\n(a) a public list that identifies a person that:\n(i) violates a chapter or section described in Subsection (2);\n(ii) without proper legal justification, fails to comply with an order, subpoena, judgment, or other legal process issued by:\n(A) the division; or\n(B) a court of competent jurisdiction; or\n(iii) breaches a settlement agreement, stipulation, assurance of voluntary compliance, or similar instrument signed by the person and the division; and\n(b) a process by which a person may be removed from the list the division establishes as described in Subsection (3)(a).","path":["Title 13 Commerce and Trade","Chapter 13-2 Division of Consumer Protection","Part 13-2-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title13/Chapter2/13-2-S102.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"c22294962f9f76da2566fd187b63062570e35dadafc54ad421e756bff3910fcf","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-13-2-101","next":"us-ut/utah-code-13-2-103"},"notice":"GroundRules: Original legal text.
