{"data":{"id":"us-ut/utah-code-13-25a-107","jurisdiction":"us-ut","citation":"Utah Code § 13-25a-107","heading":"Private action.","body":"(1) In addition to any other remedies, a person may bring an action in any state court of competent jurisdiction if:\n(a)\n(i) the person has received two or more telephone solicitations or facsimile advertisements from the same individual or entity that:\n(A) violates this chapter; or\n(B) violates Title 47 U.S.C. 227; and\n(ii) the person, following the first telephone solicitation or facsimile advertisement, notified the sender of the person's objection to receiving the telephone solicitation or facsimile advertisement; or\n(b) the person has received one telephone solicitation or facsimile advertisement in violation of:\n(i) Subsection 13-25a-103(1);\n(ii) Subsection 13-25a-103(3);\n(iii) Subsection 13-25a-103(5);\n(iv) Subsection 13-25a-103(6); or\n(v) Subsection 13-25a-104(1).\n(2) In a suit brought under Subsection (1):\n(a) a person may:\n(i) recover the greater of $500 or the amount of the pecuniary loss, if any;\n(ii) recover court costs and reasonable attorneys' fees as determined by the court; and\n(iii) seek to enjoin any conduct in violation of this chapter; and\n(b) if the court finds that a violation was knowing and willful:\n(i) the court may award an individual treble the amount of the individual's pecuniary loss; or\n(ii) the court may award an individual the greater of $1,000 or treble the amount of the individual's pecuniary loss if:\n(A) the individual who received the solicitation is an on-call emergency provider;\n(B) the individual was on call at the time the violation occurred; and\n(C) the individual had notified the sender that the individual is an on-call emergency provider.","path":["Title 13 Commerce and Trade","Chapter 13-25a Telephone and Facsimile Solicitation Act"],"source_url":"https://le.utah.gov/xcode/Title13/Chapter25a/13-25a-S107.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"3e3f08c7cb2ab8661b7c318b72db9b9f1a988c194355629e5f63eec369144f0e","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-13-25a-106","next":"us-ut/utah-code-13-25a-107.2"},"notice":"GroundRules: Original legal text.
