{"data":{"id":"us-ut/utah-code-13-34-102","jurisdiction":"us-ut","citation":"Utah Code § 13-34-102","heading":"Division responsibilities.","body":"(1) The division shall:\n(a) exercise the division's enforcement powers in accordance with Chapter 2, Division of Consumer Protection, and this chapter;\n(b) make rules in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, to:\n(i) establish the content of a registration statement required under this chapter;\n(ii) establish a process for reviewing and responding to complaints the division receives in accordance with this chapter; and\n(iii) establish a fee in accordance with Section 63J-1-504 for filing a registration statement;\n(c) issue a registration certificate or state authorization certificate to a postsecondary school upon the division's receipt and approval of a qualifying registration statement;\n(d) maintain and publish a list of postsecondary schools to which the division has issued a:\n(i) registration certificate; or\n(ii) state authorization certificate; and\n(e) deposit fees established in accordance with Subsection (1)(b)(iii), and collected in accordance with this chapter into the Commerce Service Account created in Section 13-1-2.\n(2) The division may:\n(a) accept a copy of an educational credential from a postsecondary school that ceases operation;\n(b) charge a reasonable fee for providing a copy of an educational credential;\n(c) upon request, provide a letter confirming that a postsecondary school is exempt from registration in accordance with Section 13-34-111; and\n(d) negotiate and enter into an interstate reciprocity agreement with another state, if in the judgment of the division, the agreement is consistent with the purposes of this chapter.","path":["Title 13 Commerce and Trade","Chapter 13-34 Utah Postsecondary School and State Authorization Act","Part 13-34-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title13/Chapter34/13-34-S102.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"77607d6fbb190c4274f0a4ced22d6df75ddcc618a40c00e53688d1e40637c470","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-13-34-101","next":"us-ut/utah-code-13-34-103"},"notice":"GroundRules: Original legal text.
