{"data":{"id":"us-ut/utah-code-13-34-113","jurisdiction":"us-ut","citation":"Utah Code § 13-34-113","heading":"Private right of action.","body":"(1) A person may bring an action in a court of competent jurisdiction against a postsecondary school that does not comply with this chapter.\n(2) If a court of competent jurisdiction finds that a postsecondary school violated this chapter, a person who brings an action under Subsection (1) is entitled to:\n(a) declaratory judgment that an act or practice violates this chapter;\n(b) injunctive relief;\n(c) rescission of a contract;\n(d) for a loss suffered as a result of a violation of this chapter, an amount equal to the greater of:\n(i) actual damages; or\n(ii) $2,000; and\n(e) an award of reasonable attorney fees and court costs.","path":["Title 13 Commerce and Trade","Chapter 13-34 Utah Postsecondary School and State Authorization Act","Part 13-34-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title13/Chapter34/13-34-S113.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"4b3a925d3a97a6ef7bc5dc842db0878b42df72e052d1fa0f9f35c68f8d3a309f","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-13-34-112","next":"us-ut/utah-code-13-34-201"},"notice":"GroundRules: Original legal text.
