{"data":{"id":"us-ut/utah-code-13-34-202","jurisdiction":"us-ut","citation":"Utah Code § 13-34-202","heading":"Surety requirements.","body":"(1) A postsecondary school required to obtain a registration certificate in accordance with this chapter shall maintain, in a form and amount approved by the division:\n(a) a surety bond issued by a surety authorized to transact surety business in the state;\n(b) a certificate of deposit in a financial institution authorized under the laws of this state or the laws of the United States to accept deposits from the public; or\n(c) other proof of financial viability specified in rules the division makes under Section 13-34-103.\n(2) The division shall use the surety bond or certificate of deposit as protection against loss of unearned tuition, tuition paid for credits that a student earned but that are not transferrable to a comparable postsecondary school, book fees, supply fees, or equipment fees:\n(a) collected by the postsecondary school from a student or another person on a student's behalf; or\n(b) that the student is obligated to pay.\n(3) A surety bond or certificate of deposit obtained in accordance with this section may not expire:\n(a) earlier than 60 days after the first day on which no student is enrolled in the postsecondary school; and\n(b) while students are enrolled in the postsecondary school.","path":["Title 13 Commerce and Trade","Chapter 13-34 Utah Postsecondary School and State Authorization Act","Part 13-34-2 Postsecondary School Responsibilities"],"source_url":"https://le.utah.gov/xcode/Title13/Chapter34/13-34-S202.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"012030e6977a1243e04038ab7ba402e5b90769b24a287bf0ed5510f1484316ba","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-13-34-201","next":"us-ut/utah-code-13-34-203"},"notice":"GroundRules: Original legal text.
