{"data":{"id":"us-ut/utah-code-13-39-301","jurisdiction":"us-ut","citation":"Utah Code § 13-39-301","heading":"Criminal penalty.","body":"(1) A person who violates Section 13-39-202 commits a computer crime and is guilty of a:\n(a) class B misdemeanor for a first offense with respect to a contact point registered with the unit under Subsection 13-39-201(2)(a); and\n(b) class A misdemeanor:\n(i) for each subsequent violation with respect to a contact point registered with the unit under Subsection 13-39-201(2)(a); or\n(ii) for each violation with respect to a domain name registered with the unit under Subsection 13-39-201(2)(b).\n(2) A person commits a computer crime and is guilty of a second degree felony if the person:\n(a) uses information obtained from the unit under this chapter to violate Section 13-39-202;\n(b) improperly:\n(i) obtains contact points from the registry; or\n(ii) attempts to obtain contact points from the registry; or\n(c) uses, or transfers to a third party to use, information from the registry to send a solicitation.\n(3) A criminal conviction or penalty under this section does not relieve a person from civil liability in an action under Section 13-39-302.\n(4) Each communication sent in violation of Section 13-39-202 is a separate offense under this section.","path":["Title 13 Commerce and Trade","Chapter 13-39 Child Protection Registry","Part 13-39-3 Enforcement"],"source_url":"https://le.utah.gov/xcode/Title13/Chapter39/13-39-S301.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"077083885d8ad257bc3f52b817f08f05c7324f80661b8c19f060e7ac26a6f254","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-13-39-203","next":"us-ut/utah-code-13-39-302"},"notice":"GroundRules: Original legal text.
