{"data":{"id":"us-ut/utah-code-13-52-301","jurisdiction":"us-ut","citation":"Utah Code § 13-52-301","heading":"Division enforcement authority -- Administrative fine.","body":"(1) Subject to Subsection (2), the division may enforce the provisions of this chapter by:\n(a) conducting an investigation into an alleged violation of this chapter;\n(b) issuing a cease and desist order against a further violation of this chapter;\n(c) imposing an administrative fine of up to $2,500 for each violation of this chapter; and\n(d) the division may bring an action in a court of competent jurisdiction to enforce a provision of this chapter.\n(2) In a court action by the division to enforce a provision of this chapter, the court may:\n(a) declare that an act or practice violates a provision of this chapter;\n(b) issue an injunction for a violation of this chapter;\n(c) order disgorgement of any money received in violation of this chapter;\n(d) order payment of disgorged money to an injured purchaser or consumer;\n(e) impose a fine of up to $2,500 for each violation of this chapter; or\n(f) award any other relief that the court deems reasonable and necessary.\n(3) The division shall, in its discretion:\n(a) deposit an administrative fine collected under Subsection (1)(c) in the Consumer Protection Education and Training Fund created in Section 13-2-109; or\n(b) distribute an administrative fine collected under Subsection (1)(c) to a customer adversely affected by the solar retailer's failure or violation resulting in a fine under Subsection (1)(c), if the division has conducted an administrative proceeding resulting in a determination of the appropriateness and amount of any distribution to a customer.\n(4) Nothing in this chapter may be construed to affect:\n(a) a remedy a customer has independent of this chapter; or\n(b) the division's ability or authority to enforce any other law or regulation.","path":["Title 13 Commerce and Trade","Chapter 13-52 Residential Solar Energy Consumer Protection Act","Part 13-52-3 Enforcement"],"source_url":"https://le.utah.gov/xcode/Title13/Chapter52/13-52-S301.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"f9107fc11ac7825ac9415d4aca105fab7e99347d3e2fa2c679a577adfdc1f043","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-13-52-207","next":"us-ut/utah-code-13-52-302"},"notice":"GroundRules: Original legal text.
