{"data":{"id":"us-ut/utah-code-13-75-201","jurisdiction":"us-ut","citation":"Utah Code § 13-75-201","heading":"Franchisee religious day operation protection.","body":"(1) Except as provided in Subsection (2), when a franchisee asserts a sincerely held religious belief, a franchisor may not:\n(a) unilaterally impose a religious day operation requirement;\n(b) require a franchisee to accept a religious day operation requirement as a part of an amendment to the franchise agreement; or\n(c) refuse to renew a franchise agreement based solely on a franchisee's failure to comply with a religious day operation requirement.\n(2) Subsection (1) does not apply when:\n(a) the original franchise agreement provides a religious day operation requirement;\n(b) the franchisee agrees through a renewal or an amendment to the franchise agreement to a religious day operation requirement; or\n(c) the franchisor and the franchisee enter into a franchise agreement to develop an additional franchise location that contains a religious day operation requirement.\n(3) The protections provided in Subsection (1) are not transferable.\n(4) If a court with jurisdiction finds reasonable cause to believe that a franchisor violated Subsection (1), the court may order:\n(a) actual damages, reasonable attorney fees, and costs to the franchisee;\n(b) a permanent or temporary injunction, a temporary restraining order, or other appropriate order; and\n(c) civil penalties against the franchisor in an amount not exceeding:\n(i) $10,000 for a first violation;\n(ii) $25,000 for a second violation within three years after the day on which the franchisee filed the complaint for the first violation; or\n(iii) $50,000 for a violation subsequent to a second violation within five years after the day on which the franchisee filed the complaint for the first violation.","path":["Title 13 Commerce and Trade","Chapter 13-75 Franchise Protection Act","Part 13-75-2 Franchisee Protection"],"source_url":"https://le.utah.gov/xcode/Title13/Chapter75/13-75-S201.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"9b1e57de12772c6e9fc99f761b11be5a7ea9a6c81213ac73a8297ce2c24c6373","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-13-75-101","next":"us-ut/utah-code-13-76-101"},"notice":"GroundRules: Original legal text.
