{"data":{"id":"us-ut/utah-code-13-78-101","jurisdiction":"us-ut","citation":"Utah Code § 13-78-101","heading":"Definitions.","body":"As used in this chapter:\n(1) \"Consumer\" means an individual who resides in the state.\n(2) \"Division\" means the Division of Consumer Protection established in Section 13-2-102.\n(3) \"Earned but unpaid income\" means compensation, including salary, wages, or other income, that:\n(a) a consumer earns or accrues through services the consumer provides to an employer or as an independent contractor; and\n(b) the employer or hiring party has not yet paid to the consumer.\n(4) \"Earned wage access services\" means the payment of funds to a consumer determined by:\n(a)\n(i) a consumer's representation; and\n(ii) the provider's reasonable determination of earned but unpaid income; or\n(b) employment, income, and attendance data obtained directly or indirectly by a provider from an employer or an employer's payroll service provider.\n(5)\n(a) \"Fee\" means a charge the provider imposes on a consumer for earned wage access services, expedited delivery of funds, or a subscription or membership that includes earned wage access services.\n(b) \"Fee\" does not include a voluntary tip, gratuity, or donation.\n(6)\n(a) \"Provider\" means a person that engages in the business of offering earned wage access services.\n(b) \"Provider\" does not include:\n(i) a service provider, such as a payroll service provider, that verifies, but does not fund, earned wages;\n(ii) an employer that advances a portion of earned wages directly to employees or independent contractors; or\n(iii) a person regulated under Title 7, Financial Institutions Act.","path":["Title 13 Commerce and Trade","Chapter 13-78 Earned Wage Access Services Act"],"source_url":"https://le.utah.gov/xcode/Title13/Chapter78/13-78-S101.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"7eacab18520e309ccb5b505d83d3df5f757894812f4ae63fef4b021423bba378","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-13-77-106","next":"us-ut/utah-code-13-78-102"},"notice":"GroundRules: Original legal text.
