{"data":{"id":"us-ut/utah-code-13-78-105","jurisdiction":"us-ut","citation":"Utah Code § 13-78-105","heading":"Denial, suspension, or revocation of provider registration.","body":"In accordance with Chapter 2, Division of Consumer Protection, and Title 63G, Chapter 4, Administrative Procedures Act, the division may initiate adjudicative proceedings to deny, suspend, or revoke a registration if:\n(1) the division finds that the denial, suspension, or revocation is in the public interest; and\n(2)\n(a) the registration is incomplete, false, or misleading; or\n(b) the provider or the provider's principal has:\n(i) violated, caused a violation, or allowed a violation of a provision of:\n(A) this chapter; or\n(B) a rule made by the division under this chapter;\n(ii) violated Chapter 11, Utah Consumer Sales Practices Act;\n(iii) been enjoined by a court, or is the subject of an administrative or judicial order issued in Utah or another state, if the order:\n(A) includes a finding or admission of fraud, breach of fiduciary duty, or material misrepresentation; or\n(B) was based on a finding of lack of integrity, truthfulness, or mental competence;\n(iv) been convicted of a crime involving theft, fraud, or dishonesty;\n(v) obtained or attempted to obtain a registration by misrepresenting any material fact;\n(vi) failed to provide information the division requests;\n(vii) failed to pay an administrative fine that the division or an administrative or judicial order imposed;\n(viii) failed to pay the fee to file a registration application or a renewal application; or\n(ix) failed to satisfy the requirements of this chapter or rule made by the division under this chapter.","path":["Title 13 Commerce and Trade","Chapter 13-78 Earned Wage Access Services Act"],"source_url":"https://le.utah.gov/xcode/Title13/Chapter78/13-78-S105.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"4ec1811a7e3c832f70ce4f378e6469373a2bfed40255a01d50029bd1dceaa5a6","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-13-78-104","next":"us-ut/utah-code-13-78-106"},"notice":"GroundRules: Original legal text.
