{"data":{"id":"us-ut/utah-code-16-16-1302","jurisdiction":"us-ut","citation":"Utah Code § 16-16-1302","heading":"Proper plaintiff.","body":"(1) A derivative action to enforce a right of a limited cooperative association may be maintained only by a person that:\n(a) is a member or a dissociated member at the time the action is commenced and:\n(i) was a member when the conduct giving rise to the action occurred; or\n(ii) whose status as a member devolved upon the person by operation of law or the organic rules from a person that was a member at the time of the conduct; and\n(b) adequately represents the interests of the association.\n(2) If the sole plaintiff in a derivative action dies while the action is pending, the court may permit another member who meets the requirements of Subsection (1) to be substituted as plaintiff.","path":["Title 16 Corporations","Chapter 16-16 Uniform Limited Cooperative Association Act","Part 16-16-13 Action by Member"],"source_url":"https://le.utah.gov/xcode/Title16/Chapter16/16-16-S1302.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"f859bcf42ddeba65c8c03ab44ccf0067994ed4cbef8065e1a8d4a8946b76b479","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-16-16-1301","next":"us-ut/utah-code-16-16-1303"},"notice":"GroundRules: Original legal text.
