{"data":{"id":"us-ut/utah-code-16-16-1305","jurisdiction":"us-ut","citation":"Utah Code § 16-16-1305","heading":"Proceeds and expenses.","body":"(1) Except as otherwise provided in Subsection (2):\n(a) any proceeds or other benefits of a derivative action to enforce a right of a limited cooperative association, whether by judgment, compromise, or settlement, belong to the association and not to the plaintiff; and\n(b) if the plaintiff in the derivative action receives any proceeds, the plaintiff shall immediately remit them to the association.\n(2) If a derivative action to enforce a right of a limited cooperative association is successful in whole or in part, the court may award the plaintiff reasonable expenses, including reasonable attorney fees and costs, from the recovery of the association.","path":["Title 16 Corporations","Chapter 16-16 Uniform Limited Cooperative Association Act","Part 16-16-13 Action by Member"],"source_url":"https://le.utah.gov/xcode/Title16/Chapter16/16-16-S1305.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"2d355e38ac095c0f81d85df503dc3a7a4c9a807f701bde14c21ac94c136a84cc","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-16-16-1304","next":"us-ut/utah-code-16-16-1401"},"notice":"GroundRules: Original legal text.
