{"data":{"id":"us-ut/utah-code-16-1a-305","jurisdiction":"us-ut","citation":"Utah Code § 16-1a-305","heading":"Registration of name.","body":"(1) A foreign filing entity not registered to do business in this state may register the foreign filing entity's name, or an alternate name adopted in accordance with Section 16-1a-507, if the name complies with Section 16-1a-302.\n(2) To register a name or an alternate name adopted in accordance with Section 16-1a-507, a foreign filing entity shall deliver to the division for filing an application that states:\n(a) the foreign filing entity's requested name;\n(b) the jurisdiction and date of the foreign filing entity's formation; and\n(c) any alternate name adopted in accordance with Section 16-1a-507.\n(3) If the division finds that the name requested in Subsection (2) is available, the division shall register the name for the applicant's exclusive use.\n(4) The registration of a name under this section is effective for one year after the day on which the division registers the name as described in Subsection (3).\n(5)\n(a) A foreign filing entity whose name registration is effective may renew the registration for a successive one-year period by delivering, not earlier than three months before the day on which the registration expires, to the division for filing a renewal application that complies with this section.\n(b) A renewal application renews the name's registration for one calendar year after the day on which the division files the renewal application described in this Subsection (5).\n(6) A foreign filing entity whose name registration is effective may register as a foreign filing entity under the registered name or consent in a signed record to the use of the registered name by another entity.","path":["Title 16 Business Entities","Chapter 16-1a Provisions Applicable To All Business Entities","Part 16-1a-3 Names"],"source_url":"https://le.utah.gov/xcode/Title16/Chapter1a/16-1a-S305.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-10-08T05:55:33Z","sha256":"33e06927cb0d59778bd526a750806b2f6177085432d3105c7187cd276b2b7794","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-16-1a-304","next":"us-ut/utah-code-16-1a-401"},"notice":"GroundRules: Original legal text.
