{"data":{"id":"us-ut/utah-code-16-6a-113","jurisdiction":"us-ut","citation":"Utah Code § 16-6a-113","heading":"Certificates issued by the division.","body":"(1) Any person may apply to the division for:\n(a) a certificate of existence for a domestic nonprofit corporation;\n(b) a certificate of authorization for a foreign nonprofit corporation; or\n(c) a certificate that sets forth any facts of record in the division.\n(2) A certificate of existence or certificate of authorization sets forth:\n(a)\n(i) the domestic nonprofit corporation's corporate name; or\n(ii) the foreign nonprofit corporation's corporate name registered in this state;\n(b) that:\n(i)\n(A) the domestic nonprofit corporation is incorporated under the law of this state; and\n(B) the date of its incorporation; or\n(ii) the foreign nonprofit corporation is authorized to conduct affairs in this state;\n(c) that all fees, taxes, and penalties owed to this state have been paid, if:\n(i) payment is reflected in the records of the division; and\n(ii) nonpayment affects the existence or authorization of the domestic or foreign nonprofit corporation;\n(d) that the domestic or foreign nonprofit corporation's most recent annual report required by Section 16-6a-1607 has been filed by the division;\n(e) that articles of dissolution have not been filed by the division; and\n(f) other facts of record in the division that may be requested by the applicant.\n(3) Subject to any qualification stated in the certificate, a certificate issued by the division may be relied upon as conclusive evidence of the facts set forth in the certificate.","path":["Title 16 Corporations","Chapter 16-6a Utah Revised Nonprofit Corporation Act","Part 16-6a-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title16/Chapter6a/16-6a-S113.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"ceda2eacb357be8209588cd9b702ae26066f55ece41a8f4fd05d2f036802b9a6","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-16-6a-112","next":"us-ut/utah-code-16-6a-114"},"notice":"GroundRules: Original legal text.
