{"data":{"id":"us-ut/utah-code-17-62-404","jurisdiction":"us-ut","citation":"Utah Code § 17-62-404","heading":"Plan may propose changing forms of county government -- Partisan elections.","body":"(1)\n(a) The optional plan proponent described in Subsection 17-62-403(1) shall ensure that each optional plan proposes changing the form of county government to:\n(i) for a county of the first, second, third, or fourth class:\n(A) the county commission form under Section 17-62-201;\n(B) the expanded county commission form under Section 17-62-202;\n(C) the county executive and council form under Section 17-62-203; or\n(D) the council-manager form under Section 17-62-204; and\n(ii) for a county of the fifth or sixth class:\n(A) the county commission form under Section 17-62-201; or\n(B) the expanded county commission form under Section 17-62-202.\n(b) The optional plan proponent described in Subsection 16-62-403(1) may not recommend an optional plan that:\n(i) proposes changing the form of government to a form not authorized in Subsection (1)(a);\n(ii) provides for the nonpartisan election of elected officers;\n(iii) imposes a limit on the number of terms or years that an elected officer may serve; or\n(iv) provides for elected officers to be subject to a recall election.\n(2) A county that provides for the election of the county's elected officers through a partisan election may not change to a process that provides for the election of the county's elected officers through a nonpartisan election.","path":["Title 17 Counties","Chapter 17-62 Forms of County Government","Part 17-62-4 Study Committee and Optional Plan"],"source_url":"https://le.utah.gov/xcode/Title17/Chapter62/17-62-S404.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"5a2eefcc013b570fbd038990bf5be1f2f81c4785258c7eba5a115fd1917a16fe","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-17-62-403","next":"us-ut/utah-code-17-62-405"},"notice":"GroundRules: Original legal text.
