{"data":{"id":"us-ut/utah-code-17-65-402","jurisdiction":"us-ut","citation":"Utah Code § 17-65-402","heading":"Hiring of professional architect, engineer, or surveyor -- Higher education entity restrictions.","body":"(1) Notwithstanding the adoption of some or all of the provisions of Title 63G, Chapter 6a, Utah Procurement Code, under Section 17-63-506, each county executive that engages the services of a professional architect, engineer, or surveyor and considers more than one such professional for the engagement:\n(a) shall consider, as a minimum, in the selection process:\n(i) the qualifications, experience, and background of each firm submitting a proposal;\n(ii) the specific individuals assigned to the project and the time commitments of each to the project; and\n(iii) the project schedule and the approach to the project that the firm will take; and\n(b) may engage the services of a professional architect, engineer, or surveyor based on the criteria under Subsection (1) rather than solely on lowest cost.\n(2) When a county elects to obtain architect or engineering services by using a competitive procurement process and has provided public notice of the county's competitive procurement process:\n(a) a higher education entity, or any part of one, may not submit a proposal in response to the county's competitive procurement process; and\n(b) the county may not award a contract to perform the architect or engineering services solicited in the competitive procurement process to a higher education entity or any part of one.","path":["Title 17 Counties","Chapter 17-65 County Executive","Part 17-65-4 County Assets and Contracts"],"source_url":"https://le.utah.gov/xcode/Title17/Chapter65/17-65-S402.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"f1499e44fb61192c9cfaf50db034cc5dcb368f66fb8cfdc2eac57f4b44ee30a7","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-17-65-401","next":"us-ut/utah-code-17-65-403"},"notice":"GroundRules: Original legal text.
