{"data":{"id":"us-ut/utah-code-17-68-503","jurisdiction":"us-ut","citation":"Utah Code § 17-68-503","heading":"Pretrial responsibilities.","body":"(1)\n(a) A public prosecutor shall:\n(i) institute proceedings before the proper court:\n(A) for the arrest of a person charged with a public offense; or\n(B) if the prosecutor has probable cause to believe that a public offense has been committed and a grand jury has been convened by a court;\n(ii) draw all indictments and information for offenses against:\n(A) the laws of the state occurring within the county; and\n(B) the criminal ordinances of the county;\n(iii) cause all persons under indictment or informed against to be speedily arraigned for crimes charged; and\n(iv) issue subpoenas for all witnesses for the state or for the county in the prosecution of a criminal ordinance.\n(b) A public prosecutor described in Subsection (1)(a)(i)(B) shall:\n(i) assist and attend the deliberations of the grand jury; and\n(ii) prepare all necessary indictments and arrange for the subpoena of witnesses to appear before the grand jury.\n(2) The public prosecutor may:\n(a) examine as to the sufficiency of an appearance bond that may be tendered to the court; and\n(b) upon a court order:\n(i) institute proceedings for the recovery upon forfeiture of a bond running to the state or county; and\n(ii) enforce the collection of a bond described in Subsection (2)(b)(i).\n(3) The public prosecutor is authorized to grant transactional immunity to a witness for violation of a state statute or county criminal ordinance.","path":["Title 17 Counties","Chapter 17-68 County and District Attorney","Part 17-68-5 Public Prosecutor Duties"],"source_url":"https://le.utah.gov/xcode/Title17/Chapter68/17-68-S503.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"647d90da2fdcc230f4d1d05f1c3362adfd0184c9cfd9d759523a57f20afcac1d","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-17-68-502","next":"us-ut/utah-code-17-68-504"},"notice":"GroundRules: Original legal text.
