{"data":{"id":"us-ut/utah-code-17-76-304","jurisdiction":"us-ut","citation":"Utah Code § 17-76-304","heading":"Establishment of merit commission -- Appointment, qualifications, and compensation of members.","body":"(1)\n(a) Except as provided in Subsection (1)(b), a county subject to this chapter shall establish a merit system commission consisting of three appointed members:\n(i) two members appointed by the legislative body of the county; and\n(ii) one member appointed by the governing body of a police interlocal entity.\n(b) If there is no police interlocal entity within the county, the county legislative body shall appoint all three members of a commission described in Subsection (1)(a).\n(c)\n(i) Of the original appointees described in Subsection (1)(a) or (b):\n(A) one member shall be appointed for a term ending February 1 of the first odd-numbered year after the date of appointment;\n(B) one member shall be appointed for a term ending two years after the date the term ends for the member described in Subsection (1)(c)(i)(A); and\n(C) one member shall be appointed for a term ending four years after the date the term ends for the member described in Subsection (1)(c)(i)(A).\n(ii) For a term after a term described in Subsection (1)(c), a commission member shall hold a term of six years.\n(d) If an appointed position described in Subsection (1)(a) or (b) is vacated for a cause other than expiration of the member's term, the position is filled by appointment for the unexpired portion of the term only.\n(2) A member of the commission:\n(a) shall be a resident of the state;\n(b) for at least five years before the date of appointment, shall be a resident of:\n(i) the county; or\n(ii) if applicable, the area served by the police interlocal entity from which appointed; and\n(c) may not hold another office or employment with the county or, if applicable, in a municipality served by the police interlocal entity for which the member is appointed.\n(3) The county legislative body or interlocal entity governing body may:\n(a) compensate a member for service on the commission; and\n(b) reimburse the member for necessary expenses incurred in the performance of the member's duties.","path":["Title 17 Counties","Chapter 17-76 County Emergency Personnel Management","Part 17-76-3 Peace Officer Merit System in Counties of the First Class"],"source_url":"https://le.utah.gov/xcode/Title17/Chapter76/17-76-S304.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"b889d14d42cd6744195ff2e3b0d289477e2e2babd0dabaa1edf661218f89d456","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-17-76-303","next":"us-ut/utah-code-17-76-305"},"notice":"GroundRules: Original legal text.
