{"data":{"id":"us-ut/utah-code-17-76-402","jurisdiction":"us-ut","citation":"Utah Code § 17-76-402","heading":"Applicability -- Overtime for law enforcement personnel -- Exception.","body":"(1) This section does not apply to a county subject to Part 3, Peace Officer Merit System in Counties of the First Class.\n(2) The legislative body of a county that employs a nonexempt employee engaged in law enforcement activities may, except as otherwise required by a contract or a collective bargaining agreement or federal law, enact an ordinance or pass a resolution that:\n(a) designates a work period for the nonexempt employee that is the same as, or equivalent to, a work period described in Subsection 63A-17-502(2); and\n(b) compensates the nonexempt employee for overtime at a rate of one and one-half times the nonexempt employee's regular hourly rate.","path":["Title 17 Counties","Chapter 17-76 County Emergency Personnel Management","Part 17-76-4 Provisions Unique to Law Enforcement Officers"],"source_url":"https://le.utah.gov/xcode/Title17/Chapter76/17-76-S402.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"e11746c4587f895279ba507a607b91497c57f2ea7195cfd3581b9b58577bae1f","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-17-76-401","next":"us-ut/utah-code-17-76-403"},"notice":"GroundRules: Original legal text.
