{"data":{"id":"us-ut/utah-code-17-78-1002","jurisdiction":"us-ut","citation":"Utah Code § 17-78-1002","heading":"Regulation of drive-through facilities.","body":"(1) As used in this section:\n(a) \"Business\" means a private enterprise carried on for the purpose of gain or economic profit.\n(b)\n(i) \"Business lobby\" means a public area, including a lobby, dining area, or other area accessible to the public where business is conducted within a place of business.\n(ii) \"Business lobby\" does not include the area of a business where drive-through service is conducted.\n(c) \"Land use application\" means the same as that term is defined in Section 17-27a-103.\n(d)\n(i) \"Motor vehicle\" means a self-propelled vehicle, including a motorcycle, intended primarily for use and operation on the highways.\n(ii) \"Motor vehicle\" does not include an off-highway vehicle.\n(e) \"Motorcycle\" means a motor vehicle having a saddle for the use of the operator and designed to travel on not more than two tires.\n(f) \"Off-highway vehicle\" means any snowmobile, all-terrain type I vehicle, all-terrain type II vehicle, or all-terrain type III vehicle.\n(2) A county may not withhold a business license, deny a land use application, or otherwise require a business that has a drive-through service as a component of its business operations to:\n(a) allow a person other than a person in a motorized vehicle to use the drive-through service; or\n(b) offer designated hours of the day that a customer is accommodated and business is conducted in the business lobby that are the same as or exceed the hours of the day that a customer is accommodated and business is conducted in the drive-through service.","path":["Title 17 Counties","Chapter 17-78 County Property, Programs, and Entities","Part 17-78-10 Counties and Certain Business"],"source_url":"https://le.utah.gov/xcode/Title17/Chapter78/17-78-S1002.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"afdcac12b38e4df3af45d9a73bf4b9d2591bf2dbfeb526a978b9460def0780d7","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-17-78-1001","next":"us-ut/utah-code-17-78-1003"},"notice":"GroundRules: Original legal text.
