{"data":{"id":"us-ut/utah-code-17-78-1005","jurisdiction":"us-ut","citation":"Utah Code § 17-78-1005","heading":"Prohibition on licensing or certification of child care programs.","body":"(1)\n(a) As used in this section, \"child care program\" means a child care facility or program operated by a person who holds a license or certificate from the Department of Health and Human Services under Title 26B, Chapter 2, Part 4, Child Care Licensing.\n(b) \"Child care program\" does not include a child care program for which a county provides oversight, as described in Subsection 26B-2-405(2)(e).\n(2) A county may not enact or enforce an ordinance that:\n(a) imposes licensing or certification requirements for a child care program; or\n(b) governs the manner in which care is provided in a child care program.\n(3) This section does not prohibit a county from:\n(a) requiring a business license to operate a business within the county; or\n(b) imposing requirements related to building, health, and fire codes.","path":["Title 17 Counties","Chapter 17-78 County Property, Programs, and Entities","Part 17-78-10 Counties and Certain Business"],"source_url":"https://le.utah.gov/xcode/Title17/Chapter78/17-78-S1005.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"cec638430e3df020c4f0325fb56b7cfc7e528e6848ae94aced763e9810f33ff3","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-17-78-1004","next":"us-ut/utah-code-17-78-1101"},"notice":"GroundRules: Original legal text.
