{"data":{"id":"us-ut/utah-code-17-78-407","jurisdiction":"us-ut","citation":"Utah Code § 17-78-407","heading":"County funding for a fixed guideway.","body":"(1) For purposes of this section, \"fixed guideway\" means a public transit facility that uses and occupies:\n(a) rail for the use of public transit; or\n(b) a separate right-of-way for the use of public transit.\n(2)\n(a) Except as provided in Subsection (2)(b), a county legislative body may not levy a property tax or expend revenues from uniform fees or any tax or fee imposed in lieu of a property tax, to purchase, erect, repair, rebuild, maintain, or otherwise fund a fixed guideway.\n(b) Subsection (2)(a) does not apply to a property tax levy imposed by a county for the purpose of paying for bonds if:\n(i) before January 1, 2007, the bonds were issued or approved by voters for issuance to fund a fixed guideway; and\n(ii) the county does not impose a sales and use tax authorized by Section 59-12-2217.","path":["Title 17 Counties","Chapter 17-78 County Property, Programs, and Entities","Part 17-78-4 Transportation"],"source_url":"https://le.utah.gov/xcode/Title17/Chapter78/17-78-S407.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"b2b1d4d9239b50a9eb406d17ff01dff1928f3aebac4f50a4ae10115f0b39b2b8","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-17-78-406","next":"us-ut/utah-code-17-78-501"},"notice":"GroundRules: Original legal text.
