{"data":{"id":"us-ut/utah-code-17-78-606","jurisdiction":"us-ut","citation":"Utah Code § 17-78-606","heading":"Fees for constable service of process -- Exception.","body":"(1) The legislative body of a county that contracts with a constable may set a fee by ordinance, in accordance with Section 17-64-501, for a service provided by the constable the same as the county legislative body sets fees for a county sheriff as described in Section 17-72-304.\n(2) Constable fees that exceed the amounts in Section 17-72-304 are recoverable in court:\n(a) by the constable only if the constable has received prior approval for the increased fee from the party requesting the service; and\n(b) by a prevailing party as a cost of the action only if the court finds the service and increased fee are justifiable.","path":["Title 17 Counties","Chapter 17-78 County Property, Programs, and Entities","Part 17-78-6 Constables"],"source_url":"https://le.utah.gov/xcode/Title17/Chapter78/17-78-S606.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"4c012f9e9e662a8e433b883dbd40aed908e2c77ed74bd9bd7f3e1d800bb818ee","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-17-78-605","next":"us-ut/utah-code-17-78-701"},"notice":"GroundRules: Original legal text.
