{"data":{"id":"us-ut/utah-code-17-79-702","jurisdiction":"us-ut","citation":"Utah Code § 17-79-702","heading":"Planning commission preparation and recommendation of subdivision ordinance -- Adoption or rejection by legislative body.","body":"(1) A county planning commission established as required by Section 17-79-301 shall:\n(a) review and provide a recommendation to the legislative body on any proposed ordinance that regulates the subdivision of land in the county;\n(b) review and make a recommendation to the legislative body on any proposed ordinance that amends the regulation of the subdivision of the unincorporated land in the county or, in the case of a mountainous planning district, the mountainous planning district;\n(c) provide notice consistent with Section 17-79-205; and\n(d) hold a public hearing on the proposed ordinance before making the planning commission's final recommendation to the legislative body.\n(2)\n(a) A legislative body may adopt, modify, revise, or reject an ordinance described in Subsection (1) that the planning commission recommends.\n(b) A legislative body may consider a planning commission's failure to make a timely recommendation as a negative recommendation if the legislative body has provided for that consideration by ordinance.","path":["Title 17 Counties","Chapter 17-79 County Land Use, Development, and Management Act","Part 17-79-7 Subdivisions"],"source_url":"https://le.utah.gov/xcode/Title17/Chapter79/17-79-S702.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"599be31f352c0f02e01a1830ebc60d9a4ef2c990d62ffc304ca772673c0fe85a","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-17-79-701","next":"us-ut/utah-code-17-79-703"},"notice":"GroundRules: Original legal text.
