{"data":{"id":"us-ut/utah-code-17-79-704","jurisdiction":"us-ut","citation":"Utah Code § 17-79-704","heading":"Subdivision plat approval procedure -- Effect of not complying.","body":"(1) A person may not submit a subdivision plat to the county recorder's office for recording unless:\n(a) the person has complied with the requirements of Subsection 17-79-703(6)(a);\n(b) the plat has been approved by:\n(i) the land use authority of the:\n(A) county in whose unincorporated area the land described in the plat is located; or\n(B) mountainous planning district in whose area the land described in the plat is located; and\n(ii) other officers that the county designates in its ordinance;\n(c) all approvals described in Subsection (1)(b) are entered in writing on the plat by designated officers; and\n(d) if the person submitting the plat intends the plat to be or if the plat is part of a community association subject to Title 57, Chapter 8a, Community Association Act, the plat includes language conveying to the association, as that term is defined in Section 57-8a-102, all common areas, as that term is defined in Section 57-8a-102.\n(2) An owner of a platted lot is the owner of record sufficient to re-subdivide the lot if the owner's platted lot is not part of a community association subject to Title 57, Chapter 8a, Community Association Act.\n(3) A plat recorded without the signatures required under this section is void.\n(4) A transfer of land pursuant to a void plat is voidable by the land use authority.","path":["Title 17 Counties","Chapter 17-79 County Land Use, Development, and Management Act","Part 17-79-7 Subdivisions"],"source_url":"https://le.utah.gov/xcode/Title17/Chapter79/17-79-S704.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"9c5649c2a801c4148c5058acf716b198fc19c09d65b93957ef48168c353913cb","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-17-79-703","next":"us-ut/utah-code-17-79-705"},"notice":"GroundRules: Original legal text.
