{"data":{"id":"us-ut/utah-code-17-81-303","jurisdiction":"us-ut","citation":"Utah Code § 17-81-303","heading":"Limits on political subdivisions with respect to a vested mining use -- Exception.","body":"(1) A political subdivision may not:\n(a) terminate a vested mining use, whether by amortization, the exercise of police power, or otherwise;\n(b) prohibit, restrict, or otherwise limit a mine operator with a vested mining use from exercising the rights permitted under this chapter;\n(c) require, for a vested mining use:\n(i) a variance;\n(ii) a conditional use permit;\n(iii) a special exception;\n(iv) the establishment or determination of a nonconforming use right; or\n(v) any other type of zoning or land use permit; or\n(d) prohibit, restrict, limit, or otherwise regulate a vested mining use under a variance, conditional use permit, special exception, or other zoning or land use permit issued before May 12, 2009.\n(2) Subsection (1) does not prohibit a political subdivision from requiring a vested mining use to comply with the generally applicable, reasonable health and safety regulations and building code adopted by the political subdivision including a drinking water protection zone as defined and limited to Subsections 19-4-113(5)(a) and (b).","path":["Title 17 Counties","Chapter 17-81 Agriculture, Industrial, and Critical Infrastructure Materials","Part 17-81-3 Protection of Land in a Protection Area"],"source_url":"https://le.utah.gov/xcode/Title17/Chapter81/17-81-S303.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"30402fba275ff5794a2c1d1b97c16d31d2c01f0e3ac7525d391d088b1e0916ac","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-17-81-302","next":"us-ut/utah-code-17-81-304"},"notice":"GroundRules: Original legal text.
