{"data":{"id":"us-ut/utah-code-17c-2-301","jurisdiction":"us-ut","citation":"Utah Code § 17C-2-301","heading":"Development impediment study -- Requirements -- Deadline.","body":"(1) An agency shall ensure that each development impediment study required under Subsection 17C-2-102(1)(a)(i)(A):\n(a) undertakes a parcel by parcel survey of the survey area;\n(b) provides data so the board and taxing entity committee may determine:\n(i) whether the conditions described in Subsection 17C-2-303(1):\n(A) exist in part or all of the survey area; and\n(B) qualify an area within the survey area as a project area; and\n(ii) whether the survey area contains all or part of a superfund site, an inactive industrial site, or inactive airport site;\n(c) includes a written report setting forth:\n(i) the conclusions reached;\n(ii) any recommended area within the survey area qualifying as a project area; and\n(iii) any other information requested by the agency to determine whether an urban renewal project area is feasible; and\n(d) is completed within one year after the adoption of the survey area resolution.\n(2)\n(a) If a development impediment study is not completed within one year after the adoption of the resolution under Subsection 17C-2-101.5(1) designating a survey area, the agency may not approve an urban renewal project area plan based on that development impediment study unless the agency first adopts a new resolution under Subsection 17C-2-101.5(1).\n(b) A new resolution under Subsection (2)(a) shall in all respects be considered to be a resolution under Subsection 17C-2-101.5(1) adopted for the first time, except that any actions taken toward completing a development impediment study under the resolution that the new resolution replaces shall be considered to have been taken under the new resolution.","path":["Title 17C Limited Purpose Local Government Entities - Community Reinvestment Agency Act","Chapter 17C-2 Urban Renewal","Part 17C-2-3 Development Impediment Determination in Urban Renewal Project Areas"],"source_url":"https://le.utah.gov/xcode/Title17C/Chapter2/17C-2-S301.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"41dda15e1ff5d707d87bc158d76b53d056d6556f986b4adeedef564d802105f5","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-17c-2-207","next":"us-ut/utah-code-17c-2-302"},"notice":"GroundRules: Original legal text.
