{"data":{"id":"us-ut/utah-code-17d-1-203","jurisdiction":"us-ut","citation":"Utah Code § 17D-1-203","heading":"Initiating the process to create a special service district.","body":"(1) The process to create a special service district is initiated by:\n(a) the legislative body of a county or municipality that proposes to create a special service district adopting a resolution that:\n(i) declares that the public health, convenience, and necessity require the creation of a special service district;\n(ii) indicates the legislative body's intent to create a special service district; and\n(iii) complies with the requirements of Subsection (3); or\n(b) the filing of a petition that:\n(i) proposes the creation of a special service district;\n(ii) complies with the requirements of Subsections (2) and (3); and\n(iii) is filed with the legislative body of the county or municipality in whose boundary the proposed special service district is located.\n(2) Each petition under Subsection (1)(b) shall:\n(a) be signed by:\n(i) the owners of at least 10% of the taxable value of taxable property within the proposed special service district; or\n(ii) at least 10% of the registered voters residing within the proposed special service district; and\n(b) indicate:\n(i) the residence address of each person who signs the petition; and\n(ii) if the person signs the petition as a property owner, the address or other description of the person's property sufficient to identify the property.\n(3) Each resolution under Subsection (1)(a) and petition under Subsection (1)(b) shall:\n(a) describe the boundaries of the proposed special service district;\n(b) specify each service that the special service district is proposed to provide; and\n(c) designate a name for the proposed special service district.","path":["Title 17D Limited Purpose Local Government Entities - Other Entities","Chapter 17D-1 Special Service District Act","Part 17D-1-2 Creating a Special Service District"],"source_url":"https://le.utah.gov/xcode/Title17D/Chapter1/17D-1-S203.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"f2ff9618bd37d5281a6adc3404880e87709b25bd77e9bfe367b119ef8a9ffe79","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-17d-1-202","next":"us-ut/utah-code-17d-1-204"},"notice":"GroundRules: Original legal text.
