{"data":{"id":"us-ut/utah-code-17d-1-209","jurisdiction":"us-ut","citation":"Utah Code § 17D-1-209","heading":"Notice and plat to lieutenant governor -- Recording requirements -- Effective date.","body":"(1) The legislative body adopting a resolution or ordinance approving the creation of a special service district shall:\n(a) within 30 days after adopting the resolution or ordinance, file with the lieutenant governor:\n(i) a copy of a notice of an impending boundary action, as defined in Section 67-1a-6.5, that meets the requirements of Subsection 67-1a-6.5(3); and\n(ii) a copy of an approved final local entity plat, as defined in Section 67-1a-6.5; and\n(b) upon the lieutenant governor's issuance of a certificate of incorporation under Section 67-1a-6.5, submit to the recorder of the county in which the special service district is located:\n(i) the original notice of an impending boundary action;\n(ii) the original certificate of incorporation;\n(iii) the original approved final local entity plat; and\n(iv) a certified copy of the resolution or ordinance approving the creation of the special service district.\n(2)\n(a) Upon the lieutenant governor's issuance of a certificate of creation under Section 67-1a-6.5, the special service district is created and incorporated.\n(b)\n(i) The effective date of a special service district's incorporation for purposes of assessing property within the special service district is governed by Section 59-2-305.5.\n(ii) Until the documents listed in Subsection (1)(b) are recorded in the office of the recorder of the county in which the property is located:\n(A) the county, city, or town that created the special service district may not levy or collect a property tax for special service district purposes on property within the special service district; and\n(B) the special service district may not:\n(I) levy or collect an assessment on property within the special service district; or\n(II) charge or collect a fee for service provided to property within the special service district.","path":["Title 17D Limited Purpose Local Government Entities - Other Entities","Chapter 17D-1 Special Service District Act","Part 17D-1-2 Creating a Special Service District"],"source_url":"https://le.utah.gov/xcode/Title17D/Chapter1/17D-1-S209.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"e8db9c1fccac7109c5db77a4d5ffc60c3b1a72952426affa36230bc679634bbc","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-17d-1-208","next":"us-ut/utah-code-17d-1-210"},"notice":"GroundRules: Original legal text.
