{"data":{"id":"us-ut/utah-code-17d-1-212","jurisdiction":"us-ut","citation":"Utah Code § 17D-1-212","heading":"Action to challenge the creation of a special service district or a service to be provided.","body":"(1) A person may bring an action in a court with jurisdiction under Title 78A, Judiciary and Judicial Administration, challenging the creation of a special service district or a service that a special service district is proposed to provide if:\n(a) the person filed a written protest under Section 17D-1-206;\n(b) the person:\n(i)\n(A) is a registered voter within the special service district; and\n(B) alleges in the action that the procedures used to create the special service district violated applicable law; or\n(ii)\n(A) is an owner of property included within the boundary of the special service district; and\n(B) alleges in the action that:\n(I) the person's property will not be benefitted by a service that the special service district is proposed to provide; or\n(II) the procedures used to create the special service district violated applicable law; and\n(c) the action is filed within 30 days after the date that the legislative body adopts a resolution or ordinance creating the special service district.\n(2) If an action is not filed within the time specified under Subsection (1), a registered voter or an owner of property located within the special service district may not contest the creation of the special service district or a service that the special service district is proposed to provide.","path":["Title 17D Limited Purpose Local Government Entities - Other Entities","Chapter 17D-1 Special Service District Act","Part 17D-1-2 Creating a Special Service District"],"source_url":"https://le.utah.gov/xcode/Title17D/Chapter1/17D-1-S212.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"8bcbcf1d8b0a2b29ff897e510e3559d8ea5b9cf6b59406316acb8c0e5abb21fe","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-17d-1-211","next":"us-ut/utah-code-17d-1-301"},"notice":"GroundRules: Original legal text.
