{"data":{"id":"us-ut/utah-code-17d-1-304","jurisdiction":"us-ut","citation":"Utah Code § 17D-1-304","heading":"Qualifications of administrative control board members -- Term of office.","body":"(1)\n(a) Except as provided in Subsection (1)(b), each member of an administrative control board shall be:\n(i) a registered voter within the special service district;\n(ii) an officer or employee of the county or municipality that created the special service district; or\n(iii) an owner of land, or an agent or officer of the owner of land, located within the special service district that receives, or intends to receive, service from the special service district, if:\n(A) at least 60% of the residences within the special service district are seasonally occupied homes; or\n(B) more than 50%, but less than 60%, of the residences within the special service district are seasonally occupied homes, if the number of members appointed under this Subsection (1)(a)(iii)(B) comprises less than a quorum of the board.\n(b) Subsection (1)(a) does not apply if:\n(i) at least 90% of the owners of real property within the special service district are not registered voters within the special service district; or\n(ii) the member is appointed under Subsection 17D-1-303(3) or (4).\n(2)\n(a) Except as provided in Subsection (2)(b), the term of each member of an administrative control board is four years.\n(b) The term of as close as possible to half of the initial members of an administrative control board, chosen by lot, is two years.","path":["Title 17D Limited Purpose Local Government Entities - Other Entities","Chapter 17D-1 Special Service District Act","Part 17D-1-3 Administrative Control Board"],"source_url":"https://le.utah.gov/xcode/Title17D/Chapter1/17D-1-S304.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"0485e17fae9e00e933dde61916aa96afac22c6a832a0b408e286e0d8108e6b45","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-17d-1-303","next":"us-ut/utah-code-17d-1-305"},"notice":"GroundRules: Original legal text.
